Membership and General Terms & Conditions:

   1. The S&K Rewards Program (or "S&K Style Rewards") is sponsored by S&K Menswear Inc. (or "S&K"). In becoming a member of the S&K Style Rewards program, members agree to receive advertising, marketing materials and other communications from S&K Menswear, Inc. The S&K Menswear, Inc. logo, S&K Style Rewards logo and other logos and taglines are the intellectual property of S&K Menswear, Inc. Membership rules are void to the extent where prohibited by law. Taxes may apply where required by law.
   2. S&K Style Rewards program membership ("Membership") is open to individuals of at least 13 years of age. Commercial customers and others purchasing items for resale are not eligible for membership. Employees of S&K Menswear, Inc., its affiliates and subsidiaries, and their spouses, parents or children, or members of any corporate or industrial account of S&K Menswear, Inc. are not eligible for this Membership.
   3. Membership is non-transferable and subject to present and future program rules. Membership is valid only at participating S&K Menswear, Inc. U.S. retail store locations. Style Rewards cannot be accumulated on taxes, services (including, but not limited to, alterations), gift cards and certificates, deposits, tuxedo fees and corporate apparel. Enrollment becomes effective and acceptance of these terms and conditions begins when a new member enrolls in S&K Style  Rewards on or after November 1, 2007.
   4. S&K may change the S&K Style Rewards rules, regulations, benefits, conditions of participation, or point levels for rewards, in whole or in part, at any time without notice, even though changes may affect the value of the rewards already accumulated. S&K may change or terminate program partners, withdraw, limit, modify or cancel any reward, increase the style points required for any reward, modify or regulate the transferability of rewards or benefits, institute or add reward blackout dates or limit the number of rewards for use by any one individual on any one purchase.
   5. S&K may, at any time, terminate or modify the S&K Style Rewards program and program rules without any further obligations to members.
   6. Abuse of the S&K Style Rewards including failure to follow program policies and procedures, the sale or barter of reward certificates, credits or promotional offers and any misrepresentation of fact relating thereto or other improper conduct as determined by S&K in its sole judgment may result in cancellation of the member's account and future disqualification from program participation, forfeiture of all credits accrued and cancellation of previously issued but unused reward certificates. In connection with the enforcement of any of the terms and conditions governing the S&K Rewards program, S&K reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys' fees and court costs.
   7. S&K reserves the right to interpret and apply the policies and procedures communicated in these terms and conditions. All determinations by S&K shall be final and conclusive in each case. These terms and conditions supersede all previously published terms and conditions.
   8. As a condition of membership, S&K Style Rewards members may receive print/electronic point statements via email, S&K Rewards updates and other related materials at S&K’s discretion. S&K reserves the right to cease communication of S&K Rewards updates and related materials to any S&K Rewards member.

  10. S&K reserves the right to make S&K Style Reward credits and promotional offers available to select members based on purchase activity, geographic location, program participation or information supplied by the member.
  11. A member may cancel their Membership at any time by notifying S&K Style Rewards Customer Relations at 1-800-644 SUIT or by visiting store. S&K Menswear, Inc. in its sole discretion reserves the right to cancel an individual Membership.
  12. If there is no account activity or credits from any source posted to an S&K Style Rewards member's account for two consecutive years (24 months), the account is subject to closure and termination, including forfeiture of all accrued credits.
  13. Privacy Policy: The information provided by the member will be handled according to the S&K Menswear, Inc. Privacy Policy. If a member is interested in learning more about S&K  privacy practices, please visit skmenswear.com and click on the Privacy Policy link in the bottom navigation bar.

Earning S&K Style Points:

  14. As a member of S&K Style Rewards, members earn 1 S&K Style Point for every $1 spent at S&K. Receive a $50 Style Rewards certificate for every 500 S&K Style Points earned. Style Points cannot be earned on taxes, services (including, but not limited to, alterations), gift cards and certificates, deposits, tuxedo fees and custom / corporate / group apparel orders. Member must present card at time of purchase to accumulate S&K Style Points. S&K Style points cannot be earned on purchases at skmenswear.com. S&K Style Points earned will be rounded to the nearest whole number.  
15. S&K Style Points will post to members' account within 30 days of purchase. No adjustments to members' account ("Account") will be made after 90 days from the actual purchase date.
16. Style Point calculations are based upon dollars spent at checkout on eligible purchases less any dollars spent on taxes, services (including, but not limited to, alterations), gift cards and certificates, deposits, tuxedo fees and corporate apparel.
17. Members do not earn S&K Style Points for the amount of any S&K Style Reward Certificates ("Certificates") redeemed or discounts applied. When members return products to the store or by mail, S&K Style Points previously posted to member's account for that purchase will be deducted from member's account. Other exclusions may apply. S&K Style Points apply only to the first Membership Card scanned in connection with any purchase. S&K Style Rewards and Style Points have no cash value and are nontransferable.
 18. S&K is not responsible for communications, including Certificates, lost due to change of address or other contact information. Credits that remain on member's account expire and are forfeited when the program is terminated.
  19. All credits and subsequent rewards must be earned and used according to the terms and conditions of the S&K Style Rewards program. S&K has the right to make the final decision on whether a purchase qualifies for S&K Style Points.
20. Earning S&K Style Points begins when the program is initiated, estimated to be on or around November 24, 2007.
 21. S&K Style Points are not transferable or conveyed by any means to anyone, including through a member's estate, and may not pass to members' successors and assigns. Accrued credits do not constitute property of the member. Accrued credits are not transferable by the member (i) upon death, (ii) as part of a domestic relations matter or (iii) otherwise.

S&K Style Rewards Certificates:

  22. For every 500 S&K Style Points accumulated (1 Style Point = $1 in eligible purchases) on the S&K Style Rewards program card, members will be eligible to receive an S&K Style Rewards certificate ("certificate") redeemable for $50 off the purchase of any eligible products or services at participating S&K Menswear, Inc. retail store locations. At this time, certificates cannot be redeemed at skmenswear.com. Certificates will be automatically mailed to S&K Style Rewards members within 4-6 weeks of eligible purchase.
  23. Certificates are valid for 90 days from date of issue. S&K reserves the right to change S&K Style Rewards terms at any time without notice, including imposition of new certificate expiration dates.
  24. Members in good standing may earn up to a maximum of 10 $50 certificates per year. Note: Corporate apparel / group sales are excluded from the offer.
  25. Certificates may be used in conjunction with other certificates or coupons and most other discounts or offers toward the purchase of products not to exceed purchase amount. Some exclusions may apply and there is a limit of up to two (2) certificates/discounts/offers per transaction. No photocopies or facsimiles can be accepted.
  26. Certificates are not valid on prior purchases, certain products and services (including, but not limited to alterations), purchase of Gift Cards or for tax or state fees. Certificates are not redeemable for cash and no change / points will be given for certificate redemption. Members may be notified of additional ineligible products and services. Other restrictions may apply. Lost, stolen, or expired certificates will not be replaced.
  27. Certificates are not transferable and may not be combined or conveyed by any means to anyone, including through a member's estate, and may not pass to members' successors and assigns. Reward certificates do not constitute property of the member. Certificates are not transferable by the member (i) upon death, (ii) as part of a domestic relations matter or (iii) otherwise.
